General Terms and Conditions of the Hotel Haus Hilmeke
1. conclusion of a contract
1.1 The accommodation contract is concluded as soon as rooms, premises and other services have been confirmed. All reservations shall be confirmed in writing by Hotel Haus Hilmeke. If this is no longer possible, the customer will receive a reservation number by telephone. Should the reservation confirmation deviate from the content of the registration, the content of the reservation confirmation shall become part of the contract, unless the guest objects immediately upon receipt, at the latest upon acceptance of the services.
1.2 The conclusion of the accommodation contract obliges the contracting parties to fulfill the contract, regardless of the duration of the contract. The concluded contract can only be terminated for good cause.
1.3 If the customer is not identical with the guest, both shall be jointly and severally liable for all contractual obligations.
2. arrival and departure
2.1 Unless otherwise agreed in writing, reserved rooms are available to the guest from 3 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure.
2.2 The reservation dates are binding for both contracting parties; reserved rooms are only available to the service recipient for the agreed period. Any use of the reserved rooms beyond the agreed period requires the consent of the hotel. In the event of a planned departure after 11.00 a.m., the reception must be informed by 9.00 p.m. the evening before at the latest.
3. services
3.1 The guest does not acquire any claim to the provision of specific rooms or premises. If agreed rooms are not available, the hotel shall be obliged to endeavor to find an equivalent replacement in the hotel or in other properties. The contractual scope of the hotel's services is set out in the written agreements.
3.2 If rooms or other services are reserved on an option basis, the option dates are binding for both parties. After expiry of the agreed option period, the hotel may freely dispose of the rooms and services booked on an option basis without consultation.
3.3 Unless otherwise agreed in writing, the prices are per room and night, including statutory VAT. Any increase in VAT after conclusion of the contract shall be borne by the service recipient. Agreed prices may be changed by Hotel Haus Hilmeke after conclusion of the contract in accordance with the then valid prices without prior notice if there are more than 6 months between conclusion of the contract and provision of the service. Any special conditions granted must be mentioned directly at the time of booking or upon arrival. Later changes or reductions are not possible.
4. payment
4.1 The payment for the booked services is generally due before the guest's departure. Hotel Haus Hilmeke is entitled to demand advance payments in the amount of the total expected accommodation price at any time after conclusion of the accommodation contract. The hotel may, without justification, make any order and reservation or other service to be performed dependent on the full or partial payment of amounts expected to be owed in advance, namely in the form of down payments, advance payments or total advance payments.
Hotel Haus Hilmeke may request a valid credit card number from a credit card company accepted by Hotel Haus Hilmeke in order to guarantee a reservation and for the resulting services.
4.2 If the invoice amount exceeds three times the accommodation price, Hotel Haus Hilmeke is entitled to issue individual interim invoices, e.g. in the form of weekly invoices, and to demand payment of these from the guest.
4.3 Interim invoices are payable by the Guest immediately upon receipt. If the guest defaults on payment, the hotel may terminate the agreement with immediate effect. Hotel Haus Hilmeke reserves the right to assert further costs, in particular the loss of other rentals. Invoices to companies, travel agencies, etc. will only be issued if the hotel receives a written declaration of assumption of costs from the invoice recipient on their official business stationery and this is accepted by the hotel. Such invoices are payable within fourteen days of the invoice date, without deduction and in the currency stated on the invoice. The place of performance for the Guest's payment obligations is the Hotel's registered office. This also applies if payment has been credited to the Guest.
4.4 The acceptance and selection of credit cards is at the discretion of Hotel Haus Hilmeke in every case.
The hotel is free to accept credit cards in individual cases, even if the general acceptance of credit cards is indicated by notices in the hotel. The acceptance of checks, credit cards and other means of payment is only on account of performance.
4.5 Prices for groups shall only apply on the basis of separate written agreements. Otherwise, the applicable group price lists of Hotel Haus Hilmeke shall apply. The validity of any reservation for groups is furthermore dependent on the payment of a deposit amounting to 80% of the services to be reserved, whereby this amount must be received by Hotel Haus Hilmeke four weeks prior to the arrival of the group in order for the reservation to become finally effective. In the case of group reservations, the hotel reserves the right to reduce the contingent of unused rooms and/or to change the agreed price if less than 75% of the agreed rooms are used.
5 Cancellations
5.1 In the event of changes to or cancellations of reserved hotel rooms, function rooms and arrangements, an invoice will be issued:
a) Up to 30 days before departure: 20%
b) 29th - 22nd day: 25%
c) 21st - 15th day: 35%
d) 14th - 8th day: 50%
e) 7th - 1st day: 65%
f) On the day of departure: 80%
6. liability
6.1 The guest or the organizer shall be liable to Hotel Haus Hilmeke for any damage caused by them or their guests.
6.2 Hotel Haus Hilmeke shall not be liable to the guest or the contractual partner if the provision of services becomes impossible in the event of a strike or as a result of force majeure. In such cases, Hotel Haus Hilmeke shall endeavor to procure equivalent services elsewhere.
6.3 Hotel Haus Hilmeke is liable to the guest in accordance with the provisions of the German Civil Code (up to 100 times the room rate, maximum €3000); for money and valuables in accordance with § 702 of the German Civil Code, however, only up to €750, unless Hotel Haus Hilmeke or its staff are at fault or the valuables or money were given to Hotel Haus Hilmeke for safekeeping in return for a receipt.
6.4 If the guest brings a vehicle and parks it in a parking space provided by Hotel Haus Hilmeke, the liability of Hotel Haus Hilmeke shall be limited to the liability insurance taken out for this purpose.
6.5 In the case of events, it is the responsibility of the contractual partner to insure any items brought along against theft or damage or destruction. Any liability on the part of Hotel Haus Hilmeke is excluded.
7. termination
7.1 If the guest uses the rooms provided to him for a purpose other than that agreed, Hotel Haus Hilmeke shall be entitled to an extraordinary right of termination. Political events must be clearly marked when registering. If Hotel Haus Hilmeke has reasonable grounds to assume that an event will jeopardize the smooth running of the business, the safety or reputation of the hotel or its guests, as well as in the event of force majeure or civil unrest, Hotel Haus Hilmeke may also terminate the contractual relationship without notice.
7.2 The same applies if an event organizer advertises in a daily newspaper without the consent of Hotel Haus Hilmeke, which serves to invite guests to job interviews or sales events.
8. other
Animals cannot be accommodated at Hotel Haus Hilmeke. The accommodation of an animal by the guest also entitles Hotel Haus Hilmeke to terminate the contract. In such cases, the hotel shall also be entitled to the agreed remuneration.
